PARTICIPANT WAIVER AND RELEASE OF LIABILITY AGREEMENT

Participant Information

Please read this Agreement carefully before participating at JTGamerZLounge LLC. By signing below or entering our facility, you acknowledge that you have read, understood, and agree to all terms and conditions herein.

 

1. Assumption of Risk

By entering JTGamerZLounge LLC and using any gaming or virtual reality (VR) equipment, you acknowledge that:

• Participation involves inherent risks, including but not limited to headaches, motion sickness, nausea, disorientation, or general discomfort.

• You assume full responsibility for any injury, illness, or other consequences arising from your participation.

• You will follow all posted safety guidelines and the instructions of staff members at all times.

 

2. Eligibility and Age Requirement

You represent and warrant that:

1. You are at least six (6) years of age to use VR, console, and PC gaming stations.

1. You have the legal capacity to enter into this Agreement or, if under 18, have obtained parental or legal guardian consent.

 

3. Health and Safety Warnings

JTGamerZLounge LLC does not recommend participation in VR experiences if you have:

• A history of neurological, psychiatric, or seizure disorders

• Heart conditions or other serious medical issues

• Any other condition that may be aggravated by gaming or VR immersion

• Children under six (6) years of age

If you have concerns about your medical condition, please consult your physician before participating.

 

4. Release of Liability

In consideration of being permitted to use JTGamerZLounge LLC facilities and equipment, you hereby:

• Release and discharge JTGamerZLounge LLC, its owners, officers, employees, agents, and affiliates from any and all liability for personal injury, property damage, or wrongful death that may arise from your participation.

• Waive any claims, demands, or causes of action against JTGamerZLounge LLC, whether based on negligence or otherwise.

• Agree not to pursue legal action, litigation, or any form of claim against JTGamerZLounge LLC for injuries or damages, real or alleged.

 

5. Media Release

By remaining on the premises, you authorize JTGamerZLounge LLC to:

• Photograph, film, and record your image, voice, and likeness in any media format.

• Use, reproduce, and distribute these recordings for promotional, commercial, or any other lawful purposes without compensation to you.

• Retain all rights to these recordings now and in the future.

If you do not consent to such recording or use, please notify a staff member and exit the facility immediately.

 

6. Equipment Use and Financial Responsibility

During your session, you rent space, software, and hardware from JTGamerZLounge LLC. You agree to:

• Follow all safety and operational procedures.

• Treat all equipment—including VR headsets (e.g., Vive, Meta Quest), headphones, controllers, consoles, PCs, sensors, racing simulators, and TVs—with care.

• Be financially responsible for any loss or damage to equipment caused by negligence or misuse.

• Pay the full replacement or repair cost for any damaged items.

 

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut. Any dispute arising under this Agreement shall be resolved exclusively in the state or federal courts located in Connecticut.
